Terms of Service

1. Acceptance of Terms

By accessing and using the Finlingo AI-powered financial assistant service ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

Finlingo provides an AI-powered financial assistant that helps users:

• Analyze and understand their financial data
• Receive personalized financial insights and recommendations
• Learn about personal finance through gamified lessons
• Track spending and manage budgets
• Get AI-powered financial advice and guidance
• Direct Finlingo to take certain actions on your behalf with third-party providers — such as canceling subscriptions or services, disputing charges and requesting refunds, and negotiating bills, rates, or fees (see Section 5, "Authorized Agent Services")

The Service may be modified, suspended, or discontinued at any time.

3. User Accounts and Registration

To access certain features of the Service, you may be required to:

• Create an account
• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use

You are responsible for all activities that occur under your account.

4. Financial Data and Privacy

Our Service may involve the collection and processing of financial information:

• Bank account connection is optional and requires your explicit consent
• We use Plaid, Inc. for secure financial data access
• We do not store your banking credentials
• AI-powered features (Finny chat, insights) are powered by OpenAI and require your explicit data processing consent, which you can grant or revoke at any time in the app's Privacy & Data settings
• When you use AI features, your chat messages and financial data — including transaction details (merchant names, amounts, dates, categories), account balances, spending patterns, income summaries, and financial goals — may be sent to OpenAI for processing. Your email address, passwords, and bank login credentials are never sent to OpenAI.
• We enforce automated data retention policies — certain data (conversations, notifications, insights) is automatically deleted after defined retention periods as described in our Privacy Policy
• All data processing is subject to our Privacy Policy
• You can disconnect your financial accounts at any time

By using our Service, you acknowledge that you have read and agree to our Privacy Policy.

5. Authorized Agent Services

You may direct Finlingo to take certain actions on your behalf with third-party providers ("Authorized Actions"), including canceling subscriptions or services, disputing charges and requesting refunds, and negotiating rates, bills, or fees. When you request an Authorized Action, you appoint Finlingo as your limited agent for the sole and limited purpose of completing that specific action with the specific provider you identify.

By requesting an Authorized Action, you authorize Finlingo to:

• Contact the relevant provider on your behalf by email, telephone, chat, or other means;
• Communicate as the account holder where a provider will only act on instructions from the account holder, for the limited purpose of completing the action you requested;
• Provide account-verification information you have supplied or that we hold on your behalf — such as your name, postal and email addresses, phone number, the provider's name, your account or membership number, and the last four digits of a payment card — in order to identify you to, or validate your account with, the provider; and
• Receive and process the provider's communications relating to the action, including confirmation messages.

Scope and limits of this authorization:

• Each authorization applies only to the provider and action you identify and does not authorize any other action.
• Finlingo will not provide, and is not authorized to provide, government identification numbers (such as a Social Security number), account passwords or PINs, full payment card numbers, or one-time security codes, unless you have expressly supplied that specific information for the specific action.
• Finlingo will not authorize new charges, open new accounts, or move or transfer funds on your behalf.
• You confirm that you are the account holder or are otherwise authorized to request the action for the account in question, and you are responsible for the accuracy of the information you provide.
• Authorized Actions are performed on a reasonable-efforts basis. We do not guarantee any particular outcome — including that a provider will cancel a service, grant a refund, or agree to a lower rate — or the timing of any outcome.
• You may withdraw your authorization for a pending action at any time before it is completed, using in-app controls or by contacting us, although we may be unable to reverse steps already taken.
• For actions conducted by telephone, you consent to a call being placed on your behalf and, where we record the call, to that recording in accordance with our Privacy Policy and applicable law.

Some providers' terms may restrict third-party or agent contact. You acknowledge that any Authorized Action is taken at your direction and on your behalf, and you authorize the representations and disclosures described above for that limited purpose.

6. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service or servers
• Transmit viruses, malware, or other harmful code
• Use the Service to provide financial advice to others
• Reverse engineer or attempt to extract source code
• Use automated systems to access the Service

7. Intellectual Property

The Service and its original content, features, and functionality are owned by Finlingo, Inc and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Service without our prior written consent.

8. Disclaimers and Limitations

8.1 Financial Advice Disclaimer

The information provided by our Service is for educational and informational purposes only. It is not intended as financial advice, and should not be relied upon as such. Always consult with qualified financial professionals before making financial decisions.

8.2 Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. The Service is provided "as is" without warranties of any kind.

8.3 Limitation of Liability

To the maximum extent permitted by law, Finlingo, Inc shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

9. Service Changes

You acknowledge that:

• The Service may contain bugs, errors, or other issues
• Features may be added, modified, or removed without notice
• Service availability and performance may vary
• We may collect feedback and usage data to improve the Service
• Access to certain features may be limited or terminated at any time

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including:

• Breach of these Terms of Service
• Fraudulent or illegal activity
• Service updates or program changes
• Service discontinuation

Upon termination, your right to use the Service will cease immediately.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of California.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.
